TERMS & CONDITIONS OF USE OF THE WEBSITE

We invite you to carefully read these general conditions of use (hereinafter the “T&C’s”) which govern access, consultation and use of the website www.pathe.com (hereinafter the “Site”) and its content by any person browsing the Site (hereinafter the “User”). Access to the Site and its content, their consultation and use constitute unreserved acceptance of the T&C’s.
Article 1 – Site Access
Users can access the Site freely and free of charge, without prior registration or account creation. However, telecommunication network access and usage fees remain the responsibility of the User.
The User may send requests or messages or attach photos, a CV or a script (in JPEG, PDF, and PNG format up to 4 MB) to Pathé via the contact form accessible under the “Contact Us” tab on the Site. If the User’s question concerns their cinema, their ticket or e-ticket or the organization of their screening, the User will be redirected to the customer service of the relevant country. Otherwise, if the User’s question concerns another service, the User is invited to select the relevant category from the drop-down menu. The User will then be asked to enter their first name, last name, and email address to allow Pathé to respond.
Article 2 – Modification of the T&C’s
Pathé reserves the right to modify the T&C’s at any time. The use of the Site will be subject to the T&C’s in force at the time of consultation and use of the services it offers. Pathé advises Users to regularly consult the T&C’s to be aware of any modifications or deletions that may be binding on them.
If any clause of these T&C’s is null and void due to a change in legislation, regulation, or by a court decision, this shall not in any way affect the validity and compliance with the other clauses of the T&C’s.
Article 3 – Site Content
The Site offers information and content relating to Pathé’s activities.
3.1 Information
Pathé provides Users with several sections on its Site:
- A Pathé section providing information on the management team, Pathé’s history, and key figures.
- A “Cinemas” section providing information on Pathé cinemas worldwide, on the technologies and services offered in our cinemas, and which redirects to the customer site of the country where the User wishes to purchase their ticket (e.g., to buy a ticket in France, the Site redirects to “www.pathe.fr”).
- A “Films” section that redirects the User to the site www.pathefilms.com to view trailers of films produced, co-produced, distributed or co-produced by Pathé or belonging to Pathé’s catalog.
- A “Pathé Live” section providing information on the Pathé Live offering and video excerpts. The User is then redirected to the site “www.pathelive.com” for more information and for purchasing tickets in our cinemas and partner networks.
- A “VOD” section that redirects to our video-on-demand platform available for rent or purchase without subscription or advertising.
- A “Foundation” section providing information on the Jérôme Seydoux-Pathé Foundation, including video excerpts, visuals, and downloadable documents. The User is then redirected to the site “www.fondation-jeromeseydoux-pathe.com” for more information, particularly on the Foundation’s screenings (Paris 13th).
- A “Newsroom” section providing information, press releases, and downloadable press kits on Pathé’s news and activities.
- An “Engagements” section presenting Pathé’s CSR commitments.
- A “Join Us” section presenting the Pathé company and allowing the User to apply via its recruitment platform.
3.2 Downloadable Content
We may make content available on this Site that you are authorized to download, such as Pathé’s annual brochure and CSR brochure, press releases and press kits relating to Pathé’s activity (hereinafter “Downloadable Content”).
We grant you, for your sole personal needs and/or in a strictly professional context, for journalistic communication purposes, free of charge and for the legal duration of intellectual property rights protection as defined by French and foreign legislation and international conventions, a non-exclusive and non-transferable right to use the Downloadable Content. Any reproduction, representation, modification, or distribution of the Downloadable Content is prohibited. By downloading or using this Downloadable Content, you agree to use them in accordance with the T&C’s.
3.3 User Content
The User may transmit to Pathé information, texts, questions, creative suggestions, messages, comments, feedback, ideas, notes, articles, stories, a file in PDF, PNG, JPEG format (CV, script, professional brochure, photos, drawings, graphics, etc.) via the contact form accessible under the “Contact Us” tab or by mail to the address indicated in the legal notices above (hereinafter “User Content(s)”).
The User guarantees that they hold the rights to the User Content(s) or have otherwise obtained the necessary authorizations and rights from the various rights holders concerned by any User Content(s) transmitted to Pathé, including all intellectual property rights, copyrights, industrial property rights, personality rights (and in particular the right to one’s image), and in particular the rights allowing them to communicate, upload, download, enter, and transmit said User Content(s).
The User agrees to grant Pathé, its employees, as well as its partners and rights holders, a free, irrevocable, non-exclusive, worldwide license for the entire duration of copyright as defined by French and foreign legislation and international conventions (including any subsequent supplementary or amending regulations), in any form and on any medium, by any current or future process, to reproduce, represent, use, copy, modify, adapt, publish, translate, create derivative or composite works, distribute the User Content(s), in whole or in part.
Article 4 – Site Modification
Pathé reserves the right to modify, correct, or delete content or temporarily interrupt the Site, particularly for maintenance purposes, at any time and without prior notice.
Pathé also reserves the right to remove and/or delete any data, files, and content appearing on the Site that would be in violation of any applicable law or regulation.
Article 5 – Personal data and cookies
Pathé may collect personal data concerning the User, particularly when the User browses the Site or uses the contact form. Pathé undertakes to comply with the regulations applicable to the protection of the User’s personal data, notably the European General Data Protection Regulation No. 2016/679 of April 27, 2016 (hereinafter the “GDPR”) and the “Loi Information et Libertés”.
The User has the right to access, rectify, port, erase, and limit the processing of their data, which they can exercise by sending Pathé a request via the contact form accessible on the Site or by mail to the following address: DPO Pathé, 1 rue Meyerbeer 75009 Paris (France). Pathé’s Data Protection Officer can be contacted for any request via the email address dpo@pathe.fr.
If the user believes that Pathé has not processed their personal data in accordance with the personal data protection regulations, the User has the option to file a complaint with the CNIL: https://www.cnil.fr/fr/plaintes. For more information on the processing of personal data, the User is invited to consult the “Privacy Policy” accessible on the Site.
Article 6 – Intellectual Property
6.1. Site
Pathé owns the domain name www.pathe.com.
Pathé grants Users the right to access the Site, which is limited to its sole use. By accessing the Site and each of its components (images, illustrations, videos, sounds, texts, graphic elements, branding…), including software, databases, and graphic design (hereinafter the “Content”), Users expressly acknowledge that the Site and its Content are the exclusive property of Pathé and are protected by the Intellectual Property Code as well as by applicable international treaties and agreements relating to the protection of intellectual property rights.
Pathé and/or its partners are the sole holders of all rights, titles, and interests in the Site and its Content, or guarantee that they have obtained authorization from the authors or rights holders to reproduce its Content on the Site, including all intellectual property rights, including, but not limited to, image rights, all copyright, design rights, trademarks, trade names, company names, domain names, technology, know-how, processes, formulas, source codes and executable codes, data, and similar rights, including information relating to any application, registration, or renewal thereof that may be protected by the intellectual property laws, regulations, or rules of any country. The reproduction, representation, adaptation, exploitation, distribution, modification, transmission, dissemination, commercial use, translation, arrangement, transformation, or any derivative or composite creation of all or part of the works, the Content, and any element or information appearing on the Site is strictly prohibited, on any medium whatsoever, by any means whatsoever, current or future, without the prior written authorization of Pathé. Such actions are likely to constitute acts of infringement punishable civilly and criminally, engaging the responsibility of their author. Only the download of downloadable Content accessible on the Site is authorized solely for the exclusive purpose of information for personal use and/or within a strictly professional context, for journalistic communications (e.g., annual brochure, press releases and kits, CSR report).
6.2. Trademarks
All trademarks or logos appearing on the Site are subject to the intellectual property rights that Pathé, a company in its group or a third party in relation to it may hold. Any use, in any way whatsoever, of these trademarks and/or logos is prohibited. Pathé or any company holding intellectual property rights reserves the right to claim damages in case of infringement of its rights.
6.3. Hyperlinks
Hyperlinks are accessible on the Site and allow the User to access websites published by third parties, partners, or social networks whose content Pathé does not control. Consequently, and to the extent that the hyperlinks have been included on the Site solely to facilitate the User’s navigation on the internet, consulting these published sites is the sole choice and responsibility of the User.
Pathé cannot be held responsible for access to these external sites and sources, their content, advertisements, products, services, or any other information or data available on or from these external sites or sources to which the hyperlinks present on the Site refer.
As a principle, the use of the Site is reserved for strict personal use. Any creation of links to the Pathé Site, any framing of the Site, and more generally any use of an element composing the Site, is subject to the prior written authorization of Pathé. This authorization may be revoked at any time and at Pathé’s sole discretion.
6.4 Opposition to text and data mining by generative artificial intelligence
The structure of the present Site as well as all audiovisual works and content present on the Site, as well as all of their components (text, graphics, signs, signals, sounds, images, etc.) are protected by intellectual property law and may not be used without the prior written authorization of Pathé.
As needed, Pathé hereby objects to all digital copies or reproductions of these audiovisual works, content and/or any of their protected components (text, graphics, signs, signals, sounds, images, etc.) for the purpose of text and data mining by a generative Artificial Intelligence system (AI), within the meaning of Articles L. 122-5-3, III and L. 211-3, 8° of the Intellectual Property Code (CPI), transposing Directive (EU) 2019/790 of April 17, 2019 on copyright and related rights in the digital single market.
Article R. 122-28 of the CPI specifies that this opposition “does not need to be justified and can be expressed by any means. In the case of content made available to the public online, this opposition can notably be expressed using machine-readable means, including metadata, and by resorting to the general terms of use of a website or service.”
It is recalled that in the context of its activities, Pathé may authorize its contractors and/or its press organizations to use the audiovisual works, content and/or any of their protected components (text, graphics, signs, signals, sounds, images, etc.) present on the Site, to the extent strictly necessary for the authorized exploitation or for information purposes. However, these authorizations do not permit these contractors and/or press organizations to make digital copies or reproductions of these works and/or content and/or their components for text and data mining, nor to authorize a third party to do so, particularly an AI system.
Consequently, any text and data mining operations by an AI system using audiovisual works, content and/or any of their copyright-protected components (text, graphics, signs, signals, sounds, images, etc) presented or made available online on the Site or by third parties, whether this making available is done by extracts or in its entirety, in free access for free or for a fee, constitute acts of infringement, punishable by the sanctions provided for in L. 331-1 et seq. of the CPI, unless prior written agreement is obtained from Pathé (or, where applicable, from the collective management organization to which Pathé has expressly entrusted a mandate for this purpose).
To facilitate the machine readability of this right to object or any automated data collection device, this objection is also expressed as: < TDM-RESERVATION: 1> or TDM: NO
Article 7 – Charter of Good Conduct
Each User must use the Internet and the Site responsibly, with respect and courtesy towards Pathé, and therefore undertakes not to:
- Send by mail or transmit via the contact form or to any person identified on the Site, any illegal, harmful, threatening, abusive, harassing, criminal, defamatory, vulgar, obscene, pornographic or immoral information, videos, documents or content, false or misleading, infringing on a person’s privacy, including their right to their image, hateful or objectionable on a racial, ethnic or other basis;
- Modify or alter all or part of the Site and its Content or Downloadable Content;
- Use the Site illegally, for any illegal purpose or in any manner inconsistent with the T&C’s, and to transmit via the contact form or by any other means, unsolicited or unauthorized advertising or promotional materials, or to introduce any element containing software viruses or other malicious computer code, files or programs;
- Use all or part of the Site, including its Content or Downloadable Content for commercial purposes, without the prior written authorization of Pathé, in particular for the purposes of: (i) selling access to the Site, (ii) selling advertising, promotions and sponsorship using the Content or any element of the Site, (iii) or any other act not previously authorized in writing by Pathé;
- Sell, copy, reproduce, rent, lend, distribute, transfer or sublicense all or part of the content on the Site or allow any third party to use the Site to decompile, reverse engineer, disassemble, modify, display in a readable form or attempt to discover the source code or any software activating or comprising all or part of the Site;
- Attempt to and/or bypass, disable or disrupt by any means any function of the Site (i) related to its security and its Content or (ii) preventing or restricting the use of the Content and/or the download of Downloadable Content accessible on the Site;
- Attempt to gain unauthorized access to the Site’s information/computer system or engage in any activity that disrupts, degrades the quality of or interferes with the performance or impairs the functionality of the Site, or infringes upon the peaceful access and use of the Site by Users;
- Collect any personal data accessible on the Site without the consent of the persons concerned and for any purpose not expressly authorized, or transmit to Pathé via the contact form information that allows, directly or indirectly, the precise nominative identification of a natural person without their prior written consent, such as, in particular, first name, last name, postal address, email address, telephone number;
- Access Pathé’s confidential data and private servers;
- Attempt to probe, scan or test the vulnerability of a system or network, or to breach security measures without authorization;
- Hinder or disrupt the Site, the servers or networks connected to the Site or breach conditions, procedures, policies or regulations governing networks connected to the Site or modify, adapt or hack the Site or modify a third-party site in such a way as to falsely imply that this third-party site is associated with the Site;
- Disparage the Site and Pathé on social networks or any other means of communication;
- Impersonate any natural or legal person, including but not limited to the identity of an administrator, director, employee, shareholder, agent or representative of Pathé, or falsely state that you have capital, legal or financial ties with Pathé or with any other natural or legal person working for or representing Pathé;
- Contact for commercial purposes, follow or harass any administrator, director, employee, shareholder, agent or representative of Pathé;
- Commit any illegal act. Pathé reserves the right to prohibit access to the Site to any person who does not comply with the rules of the Code of Conduct above, to put an end to any illegal act and/or to take any appropriate measure to enforce the rules set forth above.
Article 8 – Disclaimer of Warranty
To the extent permitted by applicable law, the services, offers, content, and materials presented on the Site are provided “as is” and without warranty. Pathé and its licensors, service providers, or respective suppliers do not warrant:
(i) that the Site or the Site’s functionalities will meet the Users’ needs,
(ii) that the Site or the Site’s functionalities will operate without interruption,
(iii) that the Site or the Site’s functionalities will be error-free,
(iv) that defects will be corrected,
(v) that the Site or its servers will be free of viruses or other damaging elements.
However, Pathé makes every effort to secure the Site and implement adequate security measures.
Notwithstanding Pathé’s aforementioned obligation regarding security measures, the services, offers, content, and downloadable documents obtained or otherwise obtained using the Site are at the User’s own risk; the User will be solely responsible for any damage caused to their computer system or data loss resulting from the download of such services, offers, content, or documents.
Pathé and its licensors, service providers, or respective suppliers provide no warranty and make no representations regarding the use or results of the use of the services, offers, content, and documents presented on the Site, as to their accuracy, suitability, reliability, or any other aspect.
Furthermore, unless otherwise stated in writing in the T&C’s, advice or information provided to the User by Pathé personnel or the Site does not constitute a warranty.
Article 9 – Liability
Pathé endeavors to ensure the accuracy and updating of the information and content disseminated on the Site to the best of its ability / Pathé reserves the right to correct at any time and without notice. Pathé will do its utmost to always ensure the secure and proper functioning of the Site. Pathé can in no way be held liable for indirect damages suffered by the User as defined by the case law of the French courts, and resulting from:
(a) the use of the Site or the inability to use it;
(b) the use of any content on the Site or any website accessible via the Site;
(c) unauthorized access to User data or its unauthorized modification by a third party;
(d) the behavior of third parties on the Site.
Consequently, Pathé disclaims all liability for any unforeseeability, inaccuracy, or omission concerning information or content available on the Site and for any damage resulting from fraudulent intrusion by a third party, including but not limited to computer viruses, or any malicious act, leading to modification or alteration of the information or content appearing on the Site or causing prejudice to any User of the Site; and more generally for any damage, whatever its causes, origins, nature, or consequences, caused by anyone’s access to the Site or inability to access it.
Pathé is in no way responsible for the availability or content of third-party sites or social networks. Pathé cannot be held liable for losses or damages, direct or indirect, that may be incurred by Users in the context of their access and use of the content of third-party sites or social networks. Any question relating to a third-party site or social networks should be addressed to the administrator of the third-party site or the social network concerned.
Article 10 – Applicable law and jurisdiction
The T&C’S will be governed and interpreted in accordance with French law. Any action arising from or resulting from your use of the Site or the T&C’S must be brought before the competent French courts.
